Acceptance of Terms
Welcome to BertsalSweets. By using shop.bertsalsweets.com or placing an order through it, you agree to these terms in full. If you do not agree with any part of them, please do not use the site.
Eligibility
- You must be 18 or older, or use the site with a guardian's consent and supervision.
- You must have a valid delivery address inside Kuwait — we currently deliver to all six governorates.
Accounts & Orders
The site does not offer user accounts at this time; orders are placed as guest orders. You can follow your order at any time from the Track Your Order page using your order number and registered phone number.
Pricing & Payment
- All prices are in Kuwaiti Dinar (KWD), inclusive of any applicable taxes, and delivery fees per area are shown clearly before you confirm the order.
- Payment is required to confirm an order and is made via KNET through the licensed MyFatoorah payment gateway. We never see or store your card details.
- An order whose payment is not completed remains in "Awaiting payment" status and may be cancelled automatically after 24 hours with no obligation on us.
Order Confirmation
Only an order that has reached "Paid" status is a confirmed order. "Awaiting payment" does not constitute confirmation or a final reservation of products.
Delivery
- We deliver same-day or next-day within our working hours (daily 7am–8pm), per the estimated time shown at checkout and on the tracking page.
- Delivery is carried out by our own staff or an approved third-party courier.
Cancellation
- You can cancel your order yourself from the tracking page within 15 minutes of placing it, while its status is "Awaiting payment" or "Paid".
- After that, contact us on WhatsApp as soon as possible; refund details are in the Refund Policy.
- Once preparation has started, the order cannot be cancelled.
Product Availability & Substitution
Our products are handmade in limited quantities. A product reservation is only final after payment; if an item becomes unavailable after payment, we will contact you to substitute a similar item or refund it in full.
Intellectual Property
All site content — including product photography, brand marks, logos and text — is the property of BertsalSweets and may not be used without our prior written consent.
Prohibited Uses
The following are prohibited: automated scraping of the site, reverse-engineering of its systems, and bulk ordering for resale without our written consent.
Disclaimers & Limitation of Liability
We provide our services with reasonable care. We are not liable for indirect or consequential damages, and in all cases our maximum liability to you is capped at the value of the order concerned.
Force Majeure
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, such as natural disasters, government action, or telecom and internet outages.
Governing Law & Jurisdiction
These terms are governed by the laws of the State of Kuwait, and Kuwaiti courts have exclusive jurisdiction over any dispute arising from them.
